Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and the independent individual developer who operates the Mend mobile application and related website (together, the “App” or the “Service”). In these Terms, the developer is referred to as “we,” “us,” or “our,” and the person using the App is referred to as “you.”
By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App.
1. Who provides the Service
The App is created and operated by an independent individual developer, not by a company. References to “we” or “us” throughout these Terms refer to that individual. You can reach us at mend-app@outlook.com.
2. Eligibility
You must be at least 17 years old (or the age of majority in your jurisdiction, if higher) to use the App. By using the App, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms. The App is intended for personal, non-commercial use.
3. What the App does
Mend is a self-help tool for recovering after a breakup. It helps you stay “no contact” by tracking a streak, offers tools to manage the urge to reach out (such as guided exercises, breathing, a private journal, and a “Talk to Ex” space where messages are never sent), and provides milestones, reminders, and educational content for entertainment and general informational purposes.
4. Not professional advice or a crisis service
The App does not provide professional advice of any kind and is not a medical device or a healthcare, psychological, or crisis service. Its content and features are not a substitute for advice, diagnosis, or treatment from a qualified professional. If you are in crisis or may be a danger to yourself or others, contact your local emergency number or a crisis hotline immediately. You are solely responsible for any decision you make based on the App.
5. Your content and your responsibilities
“Your Content” means any journal entry, message, note, or other material you create in the App. You retain ownership of Your Content. Your journal entries and “Talk to Ex” messages are stored only on your device and are not transmitted to us, as described in our Privacy Policy. You are responsible for Your Content and for keeping your device secure.
The “Talk to Ex” feature is a private space for your own reflection. Messages you write there are never sent to any other person. You agree not to rely on the App to communicate with anyone.
6. Acceptable use
You agree not to:
- Use the App for any unlawful, harmful, harassing, abusive, or deceptive purpose;
- Attempt to reverse engineer, decompile, interfere with, overload, or gain unauthorized access to the App or its systems;
- Use the App to build a competing product, or to train or improve any machine-learning model; or
- Misrepresent your identity or use the App on behalf of someone who has not agreed to these Terms.
7. Subscriptions, billing, and renewals
Certain features require a paid subscription (“Premium”). Subscriptions are sold and processed through the Apple App Store and are subject to Apple’s applicable terms. By purchasing a subscription you agree to the following:
- Plans and trials. Mend offers a yearly plan (which may include a free trial) and a weekly plan. Any free-trial length and pricing are shown in the App at purchase.
- Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
- Billing. Payment is charged to your Apple Account at confirmation of purchase and at each renewal. We do not receive or store your payment-card details.
- Managing and cancelling. You can manage or cancel your subscription at any time in your device’s App Store account settings. Cancellation takes effect at the end of the current billing period.
- Pricing. Prices may vary by region and may change; any change will apply to future billing periods.
- Refunds. Purchases are handled by Apple, and refunds (if any) are governed by Apple’s policies. Except where required by law, payments are non-refundable.
We use a third-party provider (RevenueCat) to manage and verify subscription entitlements on your device.
8. Changes to the App
We may add, modify, or remove features at any time, and may set or change limits on use. We may also discontinue the App. We are not liable to you for any modification, suspension, or discontinuation of the Service.
9. Intellectual property
The App, including its design, code, branding, mascot, and content (excluding Your Content), is owned by us and protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. All rights not expressly granted are reserved.
10. Third-party services
The App relies on third-party services to function, including cloud infrastructure for anonymous progress backup, subscription management, and the Apple App Store. Your use of the App may also be subject to those providers’ terms. We are not responsible for third-party services, and their availability is outside our control.
11. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CONTENT WILL BE ACCURATE OR RELIABLE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR USD 50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the App, or your violation of these Terms or of any law or third-party right.
14. Termination
You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or use the App in a way that could harm us, other users, or third parties. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of Sweden, without regard to its conflict-of-laws rules. The courts located in Sweden will have exclusive jurisdiction over any dispute, except where applicable consumer-protection law grants you the right to bring proceedings in your place of residence.
